    Georgia's Distracted Driving Law

    Georgia's distracted driving laws are quite strict. According to Georgia Code § 40-6-241, drivers must exercise due care while operating a vehicle and should not engage in any actions that would distract them.

    The Hands-Free Law in Georgia prohibits drivers from having a phone in their hand or using any part of their body to support their phone while driving. This includes making or receiving calls.

    For the first conviction of distracted driving, the penalty is a fine of not more than $50.00 and 1 point on your license. For a second conviction, the penalties increase.

    In Georgia, the use of handheld devices is prohibited for all drivers in school zones and work zones. Individuals under the age of 18, are prohibited from using cell phones or other wireless devices while driving.

    There is also a specific ban on texting while driving for all drivers, regardless of age.
